Illinois sues the Trump administration over National Guard deployment to Chicago

Illinois filed a lawsuit Monday aiming to block the Trump administration from sending federalized National Guard troops onto the streets of Chicago. However, the judge assigned to the case indicated she would not take any action until Thursday at the earliest.

State attorneys urged U.S. District Judge April Perry to issue an immediate ruling after Justice Department lawyers confirmed that members of both the Illinois and Texas National Guard could be activated in the city as soon as Tuesday.

The judge said she needed time to review the government’s response and scheduled a hearing for Thursday. In the meantime, she declined to approve a temporary restraining order.

The lawsuit claims the administration’s plan to deploy the National Guard is illegal and unconstitutional.
